There will never be depositions in this case.  The suit will be settled and the hush money will be paid, the only question is whether other women will file as well.

As for the molestation, its out.  Its not coming in because its irrelevant.  It doesnt prove a tendency towards the violence that she's alleging and bad sexual proclivities dont go towards the weight of the allegations she's making.  The fact that the records were destroyed isnt the issue. 

Yeah, the molestations aren't related to what she's claiming.  He didn't knock those victims around.  He was just "mildly inappropriate". Or so they say.

Jim Bob gonna pay upwards of a half million on behalf of the pig?  Quite possibly.  But hush money may also attract more victims, real or otherwise.

So before we were sort of hem-hawing about the fact that maybe Danica was making up the fact that her and Josh slept together.

Is that skepticism off the table now because of this? Could she say they had a sexual encounter that included all of these things and really be lying and has never met Josh in her life?

If so, could Josh come out and say "I did not have sexual relations with this woman" and sue her for slander or whatever (i'm a physicist not a lawyer!)

Basically what I'm asking is: Is this enough proof to show that Josh actually cheated on Anna with another woman? And are we done speculating that this encounter actually happened? Or could this still be made up?

I don't know if it indicates it happened or not.

What I think speaks more loudly is the fact that the Duggars haven't said Josh didn't have "lego fun time" with her. Could be nothing, but it does surprise me a bit I would think they would have denied the reports if they weren't true.

And for the record, I tend to believe Danica. Just a gut feeling I have - I could be completely wrong.

I just saw it on people. Love the sentence that there was not a spokesperson for Josh available or duggars ;) Let see how this goes. Wondering if Josh wiil stay in "rehab" longer now. They may have thought things have died down enough and Joshie could come back out quietly.....then we have this. Popcorn at the ready :popcorn:

Maybe she ended up pregnant.... emotional choice of abortion, and physical if it didn't go right, or if not, she's pregnant and can't work, and is dealing with issues from that with her DH? dunno, just speculating.

For those of you expecting Jessa to be overshadowed again-- nicely done. 

In all seriousness, this is  pretty significant. We've had speculation back and forth for months over whether or not Danica Dillon is telling the truth. Now that she's suing, it makes her seem a whole lot more legitimate. If she's lying, given the specificity of her story, it should be easily proven. That makes me think she's being honest.

This is super interesting, and I knew we hadn't heard the last from Josh.

I tend to believe Danica, so I hope she gets what is owed her, especially if her job has taken a hit since she has reported. I could see her losing a lot of work because guys might think twice about going to see her. In her line of work, discretion is a big deal. They see the fact that she reported being injured and see her as a snitch. Which is awful, but I can see it happening.

Speaking of TLC money, I'm damn entertained by the idea that the Duggars may pay off the type of woman they actively speak against.  Especially if she is married with kids?  Ohhhh....heathen.  

And, now she has started a law suit, I wonder who is next?  I doubt she is the only one he slept with.

it could be a in a trust. Depending on structure of it, it may not be accessible.

I'm going to believe Danica until I'm given hard evidence not to. I'm with @VelociRapture. I have a gut feeling.

And, honestly, I feel like it's less destructive to trust the victim on this. Based on the People Magazine comments, I feel like a lot of people are accusing her of trying a money-grab, and are responding harshly because of her career. She's been dragged into the public eye in very uncomfortable circumstances--she didn't come forward until people started commenting on her facebook iirc. We know the Duggars are fame hungry grifters, but we have no reason to believe that of Danica yet. Being a porn star or a sex worker of any kind does not indicate that.

I understand why people are skeptical, but I'm going to just take it at face value. There's no shame for me in being wrong later. It just means whoever lied is that much more of a jerk.

I bet they knew this was coming, which made hiding Josh that much more important. Keep him under lock and key and he can't screw anything else up.

It was also stated in the People article that she was suffering with anxiety since the assaults and is under treatment of a psychiatrist. It's entirely possible that she has been unable to work for that reason as well - either as a performer publicly, attending events publicly, or "entertaining" someone privately.

And it would be easy enough to have medical information provided proving that she is currently receiving treatment for that anxiety if she needed to for the lawsuit.

I'm curious what the connection is between the lawsuit and Smuggs being back at the compound? Is it perhaps because authorities were finally able to "serve" him papers or whathavenot?

Wait...are we 100% sure he's back at TTH because of this??

I have such a hard time with this. Part of me thinks Danica made up a story to get a buck. But I really hate thinking that about a person. Though it would be better to me, honestly, because I don't like the idea of someone being raped or forced to do anything they aren't comfortable with. I suppose we may never know what REALLY happened. So it's hard to have an opinion about whether or not did it or didn't happen.

I think that the Duggars will likely settle out of court no matter what happened.

It does make me sad to hear about people (Josh and Danica) stepping out on their spouses...especially when they have children. Of course that's neither here nor there as it's not a legal issue so much as a moral issue. .

i wonder how Danica will/can prove that she and josh were together. i think there was some speculation here that he was in texas during one of the the alleged encounters. i also wonder if there is video of the hotel lobby/check in desk or something like a witness to back up her claim, otherwise its a case of she said/he said unless he can prove he was elsewhere...

This explains the emergency flight to take Josh out of rehab and back to Arkansas last week.  The real shame is that Anna's money is at stake, too.  Anything that was acquired/earned during the marriage, except by gift or inheritance, belongs to them jointly.  She could lose everything, including the house, cars, jewelry, etc.  They may have to file for bankruptcy if there is a judgment they cannot pay.  Also, if they lose the suit, they will have to pay the plaintiff's attorney fees (at least $100 per hour).

And a good plaintiff attorney would evaluate the merits of her case and claims before agreeing to take her case.  I didn't look to see who her attorney is, but the complaint has specific dates and locations listed.  I think that Josh did have those two sexual encounters with her.  Not sure how much of the evidence we (as the general public) will ever be privvy to, but what would help make her case stronger would be photographs that show any bruising or other marks/injuries she might have had, testimony from friends or co-workers that she might have spoken to shortly after either incident, relating what happened and how frightening it was, records from a psychologist for her anxiety and stress, or perhaps testimony from other women who claim to have sexual encounters with Josh that turned rough or violent.

Does he even have 500k? I doubt he does. I'm thinking she had her lawyer try to shake him down to keep quiet, and when he didn't pay up, she decided to sue. Maybe Jim Bob will pony up the money to settle out of court so Josh won't have to testify and bring further negative attention to the family.
