kcrg.com/content/news/Family-Sues-Apple-Claiming-FaceTime-Distracted-Driver-in-Crash-That-Killed-5-Year-Old-Daughter-409494995.html

Parents James and Bethany Modisette are suing Apple for damages on the basis that the electronics giant failed to install and implement a "safer, alternative design" for FaceTime that would have helped to prevent a driver from using the app while traveling at highway speed, court documents show.

The fatal accident occurred Christmas Eve in 2014 near Dallas, when, according to the lawsuit, the Modisette family was driving in a Toyota Camry, with daughter Moriah, 5, in a booster seat in the left rear passenger seat and her sister, Isabella, next to her in the right rear seat.

Another driver, Garrett Wilhelm, traveling in his Toyota 4Runner in the same direction and behind the Modisette car, allegedly had his attention diverted by his use of the FaceTime app, the suit says.

"Wilhelm told police at the scene that he was using FaceTime on his iPhone at the time of the crash, and the police located his iPhone at the crash scene with the FaceTime application still active," the suit claims.

Two observations:

First, I don't think this is Apple's fault.  At some point it has to be up to people to use the devices responsibly.  Apple could modify the apps so you have to jump through flaming hoops while scratching one's self in order to use the apps and someone would still manage to fuck up.

Secondly, God, people.  Turn off the fucking devices when driving.  As John Bercow said, put the device away.  And if you don't want to get off the fucking road.

Guns, guns, guns!

kwwl.com/story/34173009/2017/01/03/dubuque-kwik-stop-employee-allegedly-points-gun-at-manager

Quote

Dubuque Police respond to Kwik Stop at 2150 Twin Valley Monday night on a call that a man was inside with a gun.

Kwik Stop employee Jeremy M. Hempstead allegedly came to work drunk, and pointed a gun at his manager. The manager then allegedly drew his own gun, and told Hempstead to drop his weapon. The manager telling all other employees to get out of the store and call 911. The manager's gun was legal.

When police arrived, Hempstead left the store, but refused to comply with their orders. As they tried to arrest him, he reportedly resisted. One of the officers has a minor injury.

Officers found a handgun in Hempstead's pocket.

Why did the sound effect "pew pew pew" just run though my head? (More importantly, why am I hearing things in my head??)

On the serious side, though, glad the officer's injury was minor.

No texting or FaceTime while driving falls under No Shit Sherlock.

As much as I have sympathy for the family, you can't blame Apple for this. I'm about to start driving lessons again soon. When I do drive my phone will be out of use. Phones should only be used in emergencies.

Just no.  This is Garrett Wilhelm's fault, period.  They need to sue him, not Apple.  I get the fact that the family wants a pound of flesh, but they need to go after the correct party.

Yeah, when a LEO knocks on your door it's not a good idea to answer with a mary jane pipe in your hand....

Last Thursday the Grant County Sheriff Department received a call to check on the well-being of a dog that had been left outside too long in the sub-zero weather conditions at a Hazel Green residence. A release from the Sheriff’s Office says a deputy knocked on the front door and 23 year old Kane Raisbeck answered holding a freshly packed marijuana pipe in his hand. The pot and paraphernalia was confiscated. Raisbeck was cited for possession of THC and paraphernalia. The dog complaint was investigated and authorities found the animal to be in good health and had sufficient shelter, food and water.

It looks like we need to teach these young folks who don't live where grass is legal yet how to deal when the fuzz comes calling.  We might not be able to use film cans to hide our stash in, but there are other things we could teach them like swallowing the roach if necessary.  (NB: I don't mean the insect type of roach; I mean the butt of a joint.)

Yeah if it was Florida man it would've been a meth pipe instead the guy was holding.

Maybe that's part of the reason why there are so many dumbasses in Florida. You hear reports of a few dumbasses and dumbasses in other states move to Florida for a sense of belonging. Keep each other company in a sense.

(Obviously this is not entirely serious.)

But yeah, stupid idea to open the door to a cop with a blunt in your hand... *facepalm*

:pb_lol: Thank you for making me almost laugh hysterically at work, I had to stop myself. I like your theory. It seems plausible.

Devon J. Torbol, 24, of <address redacted>, was arrested at 11:26 a.m. Monday on charges of possession of methamphetamine with intent to deliver, operating while intoxicated, unlawful possession of a prescription drug, possession of drug paraphernalia, interference with official acts and driving while barred.

Court documents said a Dubuque police officer saw a vehicle with sparks and smoke coming from under its hood while driving on West Fourth Street near Locust Street at about 11 a.m. Monday. The vehicle pulled over, and the officer stopped to assist.

The officer found that the license of the driver, Torbol, had been suspended, according to court documents. When a second officer arrived, Torbol fled on foot, but he was apprehended after a short foot chase. Lt. Scott Baxter said Torbol’s passenger also fled on foot and was not relocated.

Police found 4.5 grams of meth and a pipe in Torbol’s pockets, according to court documents. Torbol failed field sobriety tests, and police determined he was under the influence of a stimulant and cannabis. Torbol also had unprescribed naloxone in his vehicle.

I just read about this disgusting and horrible act in St. Louis.

cnn.com/2017/02/21/us/jewish-cemetery-vandalized/index.html

Tensions remain high in Jewish communities across the United States as police in Missouri are investigating vandalism at a historic Jewish cemetery.

Vandals toppled and damaged about 100 headstones at the St. Louis area's Chesed Shel Emeth Society cemetery in the past week, police said Monday. University City police didn't release further details about when the vandalism happened, but they said officers first responded to a report about the damage at about 8:30 a.m. Monday.

Police are reviewing security camera footage in the areas surrounding the cemetery but would not say if they considered the vandalism to be a hate crime, according to CNN affiliate KTVI-TV.

Missouri Gov. Eric Greitens tweeted Monday night that he was "disgusted to hear about the senseless act of desecration at the cemetery in University City."

The police may not want to call it a hate crime but I sure as fuck will.

I kind of want to reply to the Governor and say well dude, this is your people acting out, that you Republicans have thrown in with these anti Jewish folks so you shouldn't be surprised that your base did this shit.

Disgusting and scary. And no politician will take responsibility or acknowledge that there is a connection to the nasty rhetoric all over and hateful actions. It is always someone else's issue cause it is not our people....

Any kind of cemetery desecration makes me sick & angry. If stones fall over due to age/environmental issues, that's one thing; but this sort of crap? :my_angry:

A crowdfunding project launched by Muslim activists has raised more than $55,000 in one day to repair a vandalised Jewish cemetery in St Louis.

On Tuesday, Linda Sarsour of the grassroots civil rights MPower Change group and Tarek El-Messidi of the non-profit CelebrateMercy organisation called on people to donate after more than 100 headstones at the Chesed Shel Emeth Cemetery in the St Louis suburb of University City were toppled.

By early Wednesday, at the time of publishing, $55,341 had been raised.

According to reports, police said they did not yet know who was responsible for the vandalism.

It's up to over $75,000 now raised.  I chipped in a few bucks myself.  The crowd funding site is here  -

A douche nozzle found himself being left behind in ORD after getting stupid on a United Flight

khou.com/news/local/man-kicked-off-flight-to-houston-for-racists-remarks/411062465

Quote

A man was taken off a United flight headed to Houston after making racist remarks towards passengers on Saturday.

According to United Airlines, the incident happened on Flight 1118 as passengers were boarding and a man asked a couple if they had a bomb in their bag.

Flight attendants eventually told the man that he had to get off the plane.

The passenger who recorded the video said passengers on the plane were cheering as he and the young woman were escorted off the flight.

Given the number of stories I've heard where the couple asked the question would have been told to leave the flight, glad this one had the proper ending.
