Just came across this from September where actor Brian Cox shared his thoughts on fornicate face.

What’s ahead

The judge overseeing Donald Trump’s federal election obstruction case in D.C. is holding a hearing Monday morning on whether she should issue a gag order that would restrict what Trump can say about the case.

  • Prosecutors requested the gag. They worry that the former president’s inflammatory comments could prejudice potential jurors or intimidate witnesses.
  • On the other side, Trump’s team has argued that a gag order would violate his constitutional rights to freedom of speech, particularly as he is again running for president.
  • Judge Tanya S. Chutkan could rule from the bench on Monday — or issue a written decision later.

Highlights of last week

D.C.: Federal case on 2020 election

The details: Trump is charged with conspiring to obstruct the 2020 election results.

Planned trial date: March 4

What happened: Trump added a new attorney to his relatively small defense team: Emil Bove, a former New York prosecutor who worked on national security cases.

Her paperwork hasn’t formally been filed yet, but Kendra Wharton — a white-collar defense attorney — has also been added to the legal team and will work on multiple cases defending Trump.

  • Prosecutors and Trump’s lawyers continue to debate how the small amount of classified evidence in the case should be handled. The laws on handling classified trial evidence are complicated, and this issue will probably require multiple hearings to resolve.

Florida: Federal classified documents case

The details: Trump faces 40 federal charges over accusations that he kept top-secret government documents at Mar-a-Lago — his home and private club — and then thwarted government demands that he return them.

Planned trial date: May 20

What happened: Judge Aileen M. Cannon held back-to-back hearings to determine if lawyers representing Trump’s two co-defendants have conflicts of interest because they (the lawyers) have also represented witnesses in the case.

Prosecutors warned of potential scenarios in which the defense attorneys may not be able to provide adequate legal representation because, as part of their defense of Trump’s two employees, they would be cross-examining witnesses who are former or current clients.

  • First up was co-defendant Carlos De Oliveira, the property manager at Mar-a-Lago. He said he understood his attorney’s conflicts and waived his right to conflict-free representation. Cannon accepted his waiver. And his attorney, John Irving, said he would let another lawyer cross-examine any of his former clients, anyway.
  • But things went a bit sideways during the second hearing for Waltine “Walt” Nauta, another Trump employee who was also charged. His attorney, Stanley Woodward, pushed back against the government introducing a new argument at the hearing that was not in previous court filings. Cannon agreed with Woodward and said she would reschedule the hearing, chiding the government for “wasting the court’s time.”

Nerd word of the week

Your nerd word of the week is: Garcia hearing. This is the legal term for the proceeding Cannon held to determine if the lawyers for Trump’s co-defendants may have divided loyalties.

A Garcia hearing is held to ensure that a defendant understands their lawyer’s potential conflicts of interest — and that the lawyer may still have obligations of confidentiality to their former clients, even when cross-examining them on the witness stand.

Judges also inform defendants at a Garcia hearing that they have a right to conflict-free legal representation and do not have to stick with their current attorney.

Prosecutors often seek such hearings largely to ensure defendants don’t later try to use the issue to appeal a conviction.

Georgia: State case on 2020 election

The details: Trump faces 13 state charges, with prosecutors alleging that he tried to undo the election results in that state.

Planned trial date: None yet, though two of Trump’s 18 co-defendants are scheduled for trial on Oct. 23.

What happened: Former Trump lawyer Sidney Powell, one of the two co-defendants scheduled for trial later this month, asked Judge Scott McAfee to determine whether Coffee County had authority to permit forensic imaging of its voting machines in January 2021 to detect any irregularities.

Powell is accused of pushing and funding that forensic imaging.

  • In a court filing last week, she argued that Coffee County had authority over forensic imaging and that she had nothing to do with it. Her goal is to keep evidence related to that imaging out of her trial.

New York: State campaign finance fraud case

The details: Trump faces 34 state charges in connection with hush money paid to adult-film actress Stormy Daniels during the 2016 election.

Planned trial date: March 25

What we’re watching: Not much movement in this criminal case. We are still waiting to see if the timing of this trial collides with the D.C. trial, which is also scheduled for March, and if so whether the New York judge overseeing the case pushes the start date back.

Question time

This week, we are highlighting a reader question about the civil trial now underway against Trump, two of his adult children and his namesake company in New York.

Q. Why isn’t Ivanka Trump, Trump’s daughter, also being sued? Her brothers and dad are part of it — wasn’t she also involved in the real estate business?

We handed this question off to Shayna Jacobs, our colleague in New York who has been closely following this case. Here’s her answer:

Ivanka Trump was one of the named defendants in New York Attorney General Letitia James’s lawsuit when it was filed a year ago. In June, however, an appeals court dismissed her from the case because of the statute of limitations, saying the allegations against her “do not support any claims that accrued after February 6, 2016.”

It is so frustrating that what's his name gets away will all this. Any other defendant would get ripped a new one for rolling his eye at a judge or blinking too hard. Sadly, when you are poor, often the judge rolls right over anything you have to say and snaps at your if you so much as ask a simple question.

If he defies the gag order she will...consider consequences....seriously? 

If this was a parent dealing with a misbehaving child I would say this parent is very lenient, to everyone's detriment who ever has to deal with that child again.

"Employee testifies of alleged requests to increase Trump’s net worth"

NEW YORK — A Trump Organization employee said in state court Monday that the company’s top financial officer told him between 2017 and 2019 that Donald Trump wanted his net worth increased, testimony that could help bolster the New York attorney general’s $250 million civil fraud case against the former president.

Patrick Birney, a financial operations executive who helped assess the value of Trump properties and other real estate assets, said his boss, Allen Weisselberg, told him at a meeting that Trump wanted his wealth boosted in financial statements. Those statements of financial condition were compiled annually and distributed to lenders and insurance companies for a variety of business purposes.

Eric R. Haren, a lawyer with the attorney general’s office, asked Birney about marching orders that were allegedly conveyed to him during Trump’s presidency, while Trump’s namesake company was being run by his two adult sons and other executives.

“Did Allen Weisselberg ever tell you that Mr. Trump wanted his net worth on the [statements] to go up?” Haren asked on direct examination.

“Yes,” Birney said. “I think that happened in [Weisselberg’s] office.”

There was no additional testimony about that meeting or Birney’s understanding of what it meant.

Last year, New York Attorney General Letitia James (D) sued Trump, his adult sons, his company and two longtime employees, including Weisselberg, alleging a vast fraud that involved illegal conduct and deception. James is seeking the recovery of $250 million in allegedly ill-gotten gains and restrictions that would essentially cripple Trump’s ability to continue conducting business in the state.

New York Supreme Court Justice Arthur Engoron has already ruled in James’s favor on the issue of whether fraud was broadly committed. As part of that pretrial ruling, Engoron set in motion the beginning of a receivership process and the ultimate dissolution of Trump Organization entities that are chartered in New York state. Those charters were ordered revoked.

Legal experts have said the ruling could mean that Trump loses control of his properties, including Trump Tower on Fifth Avenue, where the company is based and where he keeps a penthouse residence.

Lawyers for the attorney general’s office contend that specific criminal acts were committed to advance the fraud. The civil case cannot result in criminal convictions or prison time for any of the individuals named as defendants.

Trump and his attorneys, who deny any wrongdoing, maintain that nothing was amiss in the company’s practices, that differences of opinion over commercial real estate values are routine and that the parties that received values from the Trump Organization did not rely on the statements in their decision-making.

The trial opened in New York Supreme Court on Oct. 2 with Trump making an appearance for three consecutive days.

In the hallway, the Republican candidate for president in 2024 repeatedly railed against the judge and the attorney general. A partial gag order was imposed after Trump posted identifying and false information about a court staffer on social media.

Trump may return to court Tuesday. His appearance was originally expected to coincide with the testimony of his former attorney Michael Cohen, but Cohen is now expected to testify at another time.
