If there's no nudity it's not pornography. I personally think that it should be illegal, but if the municipality doesn't have a law against it, there's not a lot you can do. Now, had he taken the picture and it turned out the girl wasn't wearing underwear, then he would have been in possession of child pornography. Not that I'm advising minors to not wear underwear.

The more disturbing thing is a category of child erotica where creepers take pictures of kids playing outside, or they copy pictures that their parents post online and view or trade those. I'd say upskirt pictures fall somewhere inbetween those two.
