Three days later, a magistrate judge ordered the parties to convene at an initial pretrial conference on January 21 at the U.S. Courthouse in Philadelphia, Pennsylvania.

Judge Kearney ordered Duggar to file a memo on January 11, and Dillon to file her response by January 19.

Four is Enough

The attempt to move it to federal court is just another delay tactic. I think they're still hoping this will all go away.

I am sure they are hoping it goes away as much as we are hoping it does not. I just personally want to see some uneasiness on Josh's part. He lays these golden eggs and runs for the hills leaving his wife to deal with the outcome. Why? He is the one who committed these acts and needs to have the nays to deal with them. But, he doesn't. Daddy and Mama are taking care of him. He is in hiding. At some point, he has to come out of hiding and deal with it. I would also like to see JB doing some sweating and it isn't his case so to speak. He may not be allowed by the judge to have the control he wants to have since his son is way above legal age.

What makes no sense to me is that while both the molestation and cheating are bad things; the Duggar's believe that Josh cheating on Anna is MUCH MUCH worse and he needs to go to rehab and have treatment etc.

Yet they took over a year to go to the police about the molestation and then shoved it under the carpet like it never happened. WHAT is wrong with these people?!

But in their minds they did deal with it.  They didn't need to go to the police because heathen authority is not as important as Gothard's authority.  So they went to the church, he confessed, was probably beaten, the girls probably thought about what they needed to confess and so it was dealt with.  No further need to talk about it, and when it wasn't he was sent to christian rehab then too. Now this is current, and how are they reacting?  They are looking to their Gothard authority and sending him to christian rehab.  I don't see how its that different in their minds.  The difference is that we know that one was worse, was illegal and may have indicated a need for real help.  They honestly don't think he needed more help until he resinned.

I think they also see it as by cheating, Josh broke his marriage vows made before God. It isn't as though people make a vow to God not to molest their sisters. Plus, marriage is supposed to make life easier and perfect. You don't even have to have an accountability buddy once you are married because the bonds of marriage protect you from all things evil, i.e. lusting after someone who is not your spouse. I wouldn't be surprised if fundies think it is impossible to lust after someone else once you are married.

What is wrong with you???   (LOL)   That wasn't molestation!   That was a curious little boy that was groping his sisters and that other girl.   They 'fixed' the problem of him groping by sending him off to 'rehab camp'.   He hasn't touched little girls since!


The issue is he was publicly outed by the cheating on his wife.    That really put all of those Godly people in a bad light - because now he is a big boy and he PROMISED to be faithful to his wife in front of God and EVERYONE!   And besides, he (hopefully!) used condoms which is as bad as 'spilling your seed' - he wasted all those baby makers!

It's not a delay tactic. Philadelphia is the scene of only one of the "incidents" and neither party lives in PA, therefore a request to move it to federal court is in order.   It's a prudent move on Josh's attorney's part to try to move the case to a more favorable jurisdiction in order to put more pressure on the other side.  If it gets moved  from the Philly Court of Common Pleas to federal court, she may well be more likely to settle out for very short money as she's less likely to prevail in federal court.

But now he's a member of the local chapter of FRC and believe it or not a fundie/fundie lite motorcycle group.  So he's repented from all that worldly schoolin'

Me too, all of "Commitment to Christ" spiel in the firm's history would make me go the other way, it's just another way (to the leghumpers) of showing that the Conservative Christian Duggars  are being represented by a Conservative Christian lawyer ("from the real America") in their fight against that Jezebel who wants the case heard in evil liberal Philadelphia. Also, I went to the Wilmington Campus of Widener University not Harrisburg.

President Obama did a campaign rally at Widener University in 2008 (I attended).  I wonder how this lawyer feels about that.  

And I live 1.5 hours away from Philly.... should I take one for the team and Duggar stalk the courthouse?  Is it worth the drive?

How many of these court dates will Josh have to actual have to attend? and how many can the lawyer be there to represent him? I have been anxiously following an case about a large LDS family and the last 5 out of 6 court dates just the lawyer was able to appear instead of the defendant.

It's a civil case so other than actually being there on the day he takes the stand or if the court should order his appearance for a specific reason, Josh doesn't have to be there at all. The lawyer needs to be there everyday but the defendant or plaintiff themselves does not.

The fundie moral code about sex is really weird in that they place very little to no value on consent. I'm not even sure if consent as a concept even exists to them in any meaningful sense; ATI teachings indicate that they don't think marital rape is a thing, and that in an incident of sexual violence, all parties involved are to be held accountable. It's a deplorable mindset, to be sure, but to them, sexual sin is sexual sin is sexual sin. They don't differentiate between rape and adultery and homosexuality because it's all non-marital sex (or sex acts) and therefore all not okay.

They don't tolerate moral relativity or ambiguity, so creating a sin hierarchy where consensual homosexual sex is worse than consensual adultery is worse than spousal rape is worse than molesting your sisters doesn't make sense. They also adhere to an odd, sola scriptura interpretation of the Bible that says that all sins are equal, and that quibbling over whose and which sins are worse than others is, itself, a sinful act. This mentality is the end result.

If you don't I am also willing to take one for the team cause I'm about 10-15 minutes away from center city.

Josh won't have to attend anything but his deposition, should it get that far.  He won't be at any of the the scheduled conferences or hearings.

I don't think he would.  What benefit would that have for anyone in the Duggar family?  Being judgement proof is one thing Josh has in his favor.  Not being able to pay the required amount wouldn't look as bad as losing would, he might pay to settle and avoid some discovery, but there is no good reason to pay after that.
