I'm not optimistic though.  I get the feeling that little bastard and his mother are probably still going to get off with little more than a slap on the wrist.

Unfortunately I could see this happening, sigh

I hope they do throw the book at both of them.  It is unfortunate that money buys influence and these people will probably get off with a stern warning and maybe a day of picking up litter on the side of the road.

Bail will be set, his parents will pay it for him and his mom, and they'll be off again. All that will stop him is his death.

I don't know why this country's so lenient on drunk drivers.  When I was 18 and still lived with my parents, my drunk mother was behind the wheel and hit a cop, and they were let out of jail into my custody that night.  I was 18 and lived with them, so couldn't say no.  My parents had started drinking a few years before, and that wasn't a first offense.  It wasn't their last.  I don't have anything to do with them anymore, but they're still racking up drunk driving offense.

We've got people sitting in jail for smoking a few joints.  Better keep the peaceful potheads locked away.

Escaping custody, violating the terms of your bail, and or blowing off court dates is frowned upon by courts, and it could be that Crouch is punished more severely for that than for the vehicular homicide charges.

Not to mention leaving the country.  I dont think Ethan will be getting a bond this time.

According to this CNN article, the DA explains that the most time he can get is 120 days because thats the max for violating juvenile probation.  If they get the case transferred to big boy court he will have to violate again before he sees any real time.

http://www.cnn.com/2015/12/29/us/affluenza-teen-ethan-couch-detained-in-mexico/index.html

Quote

The district attorney explained the dilemma she faces at a news conference Tuesday:

  • Ethan Couch was sentenced as a juvenile and violated his probation as ordered by juvenile court system.
  • Under Texas law, Couch, now 18, would be punished for his violation in the juvenile system.
  • The maximum sentence that a juvenile judge can dish out for a violation of his juvenile probation is imprisonment in a juvenile facility until Couch turns 19, which is April 11, 2016.
  • The DA wants to transfer Couch's sentence to adult court. But since this violation happened in the juvenile system, Couch effectively would start with a clean slate in the adult probation system. That is, the adult court judge could not punish Couch for violations he committed as a juvenile.
  • At the time a judge reassesses Couch's probation in the adult system, he has the power to put Couch in adult jail for a maximum of 120 days.

The 120 days in jail won't please those who think Couch deserves worse, but as the facts stand now, it is what the law allows.

If Couch ends up on adult probation, Wilson said, and violates it as an adult, he could face up to 40 years in jail. Couch could also find himself behind bars for longer if he is found to have committed any new crimes and is charged and convicted as an adult for those crimes.

I swear money plus being white gets you anything in this country. Texas sentenced a man to 40 years in prison for stealing ribs. The man was black. Yet white rich kid kills 4 and gets off. Only in America.

So basically, he gets nothing for his antics. 4 lives lost, a kid and his parents who have no remorse and feel that they are above the law. He commited these crimes at 16, but he was old enough to know right from wrong. He knew driving while drunk was illegal. He didn't have to drive anywhere at all - just showing off to his buddies.  At 16, when you make life altering choices like the one he made, he should stand in Adult Criminal court and be held accountable for his actions. Instead, money talks and the kid gets a very minor sentence compared to the crime he commited. And doesn't even respect it enough to obey the few rules set out for him.

This just makes me weep.

I think this kid will probably end up like OJ Simpson, in that even if he got off for killing someone, he'll end up committing another serious crime because he's convinced he's invincible. However, I don't think the "affluenza" defense will work again, especially since he's already eighteen and there's been so much public outrage about this case.

There's a German word, Backpfeifengesicht, that means "a face in need of a fist."  That word came to mind when I saw his picture.

This butthead makes me so mad. I live in one of the Orlando neighborhoods where you can walk, but I have to use my car to get literally anywhere else. Granted, we have cabs and uber and all that, but if I didn't want to pay, I'd just stop drinking in time to drive, or I'd stay over- or go home with someone where I could stay. I see both points, but this story drives me up the darn wall.

Also, I would love to see his mom get in major trouble. Is there a provision for punishing the adults in this case?

Theres likely some version of harboring a fugitive.  He dyed his hair, its going to be hard to argue they didnt know he was wanted.

I also read that friends and family even threw a "going away" party for Couch and his mother right before their flight, so obviously quite a few people knew they were planning to flee the country.

According to a report I just read on cbs news, it looks like this little weasel's attorneys have filed a writ to postpone his extradition. CBS also said this morning that Mother Weasel could face third degree felony charges and could get more time than her spawn. I would love to see them make an example of her and give her the max. I wonder if sonny boy would even bat an eyelash.

At some point he needs to stop being treated with kid gloves.  He's an adult now, time to get treated like it. Who cares if he's rich?

I am sitting here reading some of the articles and what amuses me that they are so "rich" that they  had to hide out in a resort town. No its unthinkable to actually maybe hide some where less "hey I am right here"

They may have a lot of money but they certainly weren't blessed with good looks. :/

According to CNN they've managed to delay the deportation.  No idea why they would want to stay in mexico longer than need be.

There has to be a very specific legal strategy/advantage for keeping him in Mexico, but I can't find anything, even going 10 pages deep on google.    Dad must still be footing the legal bills, because now they have a high-powered Mexican lawyer.

I was watching some footage of Tonya Couch at (I think) her recent hearing and she just radiated "alcoholic" to me.

Well, they would certainly blend in better with the hordes of American tourists, than in a non-tourist destination.  It didn't appear that they were staying in a luxe apt, but the show I saw on TV said that Ethan went to a stripper club called Harem and ran a $1000 tab, but he was over $300 short. This  tells me he was drunk, at a Mexican strip club, carrying about $700 in cash.  A stupid move anywhere.  According to this on-line article, a club employee escorted him back to his hotel, but his mom didn't have enough $$$ to pay the bill, so Ethan's Rolex (!) watch was given as security.  The next day, they abandoned the hotel and got a condo (according to this story, which differs just slightly from the TV story).

abcnews.go.com/International/affluenza-teen-drank-strip-club-mexico/story?id=36099672

Anyway, it made me wonder if they didn't leave the US only to escape US legal fallout from the party video, but rather they just needed to get to a place with a party/drinking scene where Ethan (and his mom) could drink to their respective heart's content.

What confused me is that if all the local Texas authorities had on him was a video of him at a party with drinking, then why flee the country with your mom? Why change both people's hair color?  And, then, what's in it for the U.S. authorities to then call in the Feds and immigration and put this as a top priority?  A parole violation while he's still a "juvenile" (for the sentencing purposes) does not indicate a top priority in finding a person.  I think that there is more to the story.
