This article popped up on my newsfeed. Nothing really new, except for one quote in particular..

I wonder if the timing isn't due to stalled settlement discussions and she called their bluff and filed a suit. I think it's a negotiation strategy and well-timed to coincide with Spurgeon's birth and the upcoming specials. I don't think either side wants to go to trial and deal with what would come out in a public preceding. It'll go away soon, I'm guessing.

I concur with this. There is usually a step, pre-court, where lawyers send a letter saying, "Just wanted to let you know, we're planning to file a lawsuit. Feel free to get in touch if you'd like to talk to us first..."

There is a set period of time, usually, before that "offer" expires and things get going in court.

As the alleged assaults happened this April, Danica-Ashley had until April of 2017 to bring a lawsuit in PA.  

A plaintiff is not required to first give a defendant an opportunity to settle.  She may well have.   It's also very possible that the lawsuit was Josh's first notice of the claim.

I'm still intrigued by how fast Josh got rid of the house he and the Kellers and Davy Waller had been working on just a few weeks before Scandal II broke.   Danica hadn't yet (or had just) surfaced.  Makes you wonder if he was concerned about more than a single or particular individual possibly suing him.

Yeah, Jim Bob clearly never had a peer group that taught him that being a horney asshole in public and obsessing about sex are not cool, period. He doesn't understand how to behave, I think. Whatever he taught his sons is unlikely to be what society would see as normal.

I don't know how typical this behavior of Jim Bob's was, but I can't get over his behavior when he and Michelle went to "chaperone" Jessa and Ben's first date. They all went to miniature golf and Jim Bob at one point was trying to get Jessa and Ben's attention by humping Michelle from the back while, supposedly showing her how to hold a club. (Try that with me and he'd get a really good idea of how I hold a club, and what I aim it for if someone's dry-humping me. I HOPE it was dry-humping, anyhow. Wouldn't want that precious sacred Jim Bob-seed to go to waste.)

If I remember correctly he seemed to be trying to encourage Ben to do something similar with Jessa: show her "how to use a club" while holding the club in front of her and, well, jiggling up and down against her butt. Yes, let's chaperone them by encouraging Ben to dry-hump our daughter! That's just as appropriate as can be! Did he really want to SEE Ben do this? And if so, why? Would doing that be okay with him, a way of male bonding--"Let's both hump our unwilling ladies!"?

He's a creep. If this is his idea of being a "chaperone" it would have been better if the courting couple had been able to be alone, with or without a film crew. Michelle was clearly mortified. Ben was stoic and paid Jim Bob minimal attention (which I think was great). Jessa was embarrassed and looked angry.

Now in any kind of a normal family Ben would have said farewell at the end of the date and before the door closed Michelle and Jessa would have ripped Jim Bob into shreds. Didn't this happen? Wouldn't Michelle at least have had a quiet word to say that she'd felt uncomfortable?

Anybody here whose father would have seen this whole business as a good idea, at any point in a daughter's life? My old man would have killed himself first.

If Jim Bob is this tone-deaf to appropriate male-female behavior, what are the chances that Josh would be clueless too? Jim Bob wasn't raping Michelle, but he was certainly inflicting unwanted and humiliating sexual contact . . . a bit like Josh with his sisters and with Danica?

Although it is possible Danica may be trying to get money or limit Josh caused damage to the world at large, I haven't seen anyone else bring up another form of compensation. Danica just got the most astonishing, world-wide free PR any sex worker could ever hope to have. All kinds of new customers and even porn or possibly low end tv or film roles could come out of this second round of massive PR for her.

I tried to answer a similar question in the earlier thread.  This is a general response to the question:  Why do people sometimes wait for a period of time before filing a personal injury lawsuit?  Danica did not file a criminal complaint against Josh.  Only a governmental agency could do that - the D.A.'s office in the country where a crime took place.  She's filing a civil lawsuit claiming that she suffered personal injuries (anxiety, stress) and that these injuries are affecting her ability to work and earn a living in the manner she was doing prior to her encounters with Josh.  In civil lawsuits, you have a time frame designated by law in which to file your lawsuit.  There is no need to rush on filing your suit.  It doesn't diminish your claim in any way.  That time frame is often used by attorneys to gather information and to attempt to resolve the case without the need for a lawsuit.  Maybe Danica wasn't sure whether she wanted to pursue a case against Josh; or maybe she started having panic attacks and they kept getting worse and she feels they are connected to her encounters with Josh.  I don't know the exact reason - only that it doesn't mean anything shady.  It only means that she didn't file her lawsuit until this moment in time, but well before the statute of limitations had run.

As to her asking for $500,000 or more in damages - that's also not uncommon in personal injury lawsuits.  It rarely has anything to do with the actual settlement amount.  I'd be surprised if this case ever reaches a jury.  Seems like the wisest course would be to enter into settlement talks.

In my experience in Australia, cases involving psychiatric injury are often brought months/years after the tort because symptoms may not develop for a while or not reach a level of clinical diagnosis for several months. Furthermore, people often don't seek medical/psychiatric help for their symptoms until weeks, months or years after the trauma.

In my view (and in my jurisdiction) the delay does not diminish her claim. In fact, in New South Wales judges must instruct a jury that any delay in bringing a claim in regard to a sexual events must not be seen as evidence against the plaintiff - ie, delay in bringing a claim is not evidence that it did not occur or that the injury is not significant.

I agree with @EmmieJ in respect of the figure of $500,000 too. You generally claim the maximum allowable for the injury so that you don't reduce the quantum of any eventual judgment. So, you claim $1mill so that a judge can award $1mill, whereas if you claim $10k, a judge is often unable to award $1mill in circumstances where they would have done so in other circumstances.

Does anyone agree with the rumor that Josh may have been kicked out of or possibly chosen to leave Reformers United on short notice? Sante Center for Healing was brought up in one tabloid article as a possible new location for Josh. IF so and yes it is a huge if, the Google reviews don't make it sound like a particularly effective treatment center. Lots of former clients complaining about money grubbing practices and lack of professionalism among the staff. Interestingly people either loved it or hated it. Not much middle ground. If Josh is there JB still has some money as the place runs $30K a month according to reviewers posts. 

Whatever happened to the "second porn star" who was going to go public "soon"? I never saw a name attached to that rumor.

Maybe Jim Bob really negotiated For Jessa and Jill get these spin off specials so they would get a nice paycheck to help Contribute to the "Josh payoff fund". I wouldn't put it past him to encourage the girls, if it even goes to them in the first place, to help get this little problem taken care of...

Perhaps the lawsuit is Danica's way of seeking justice and revenge for Josh raping/assaulting her. As we all know women who work in the sex industry aren't believed when they say they have been raped/assaulted, and no criminal charges are filed.

Just to be clear, no means no regardless of one's occupation. I'm on Danica's side.

I seem to recall that Joshley went and used someone else's photo on one of his OkCupid or Ashley Madison profiles.  And that person wasn't too happy and was thinking of taking Mr. Joshley to court.  Did anything ever come of that?

Obviously, I have screwed up the quote.

Anyway. "On or about" is always used when writing a complaint or motion. It gives you leeway even when you know that exact date. 

I will stay in my lonely corner as someone who believes that Danica is only looking for money. I don't think she was psychologically damaged. I don't think she has gathered her strength to confront her abuser.  I don't think she is a champion for abused women. I don't think she went to Radaronline or wherever it was, and hooked herself up to a lie detector test for any other reason than money.This may have been the dumbest think she could have done as it will completely affect her credibility in front of a jury.I think she sees an opportunity and has decided to take it. Had she filed the lawsuit without the lie detector/interview fiasco I would have given her more credit. Danica being a stripper or prostitute doesn't make me doubt her. It's the convoluted and ridiculous story she tells that makes me disbelieve her. 

If she did have sex with Josh, and can prove it, I think the lawsuit will settle. Not necessarily because he is guilty of anything against her but because it is cheaper to settle than spend the money to take a case to trial. I don't for a minute believe that there will ever be depositions, a trial or anything juicy for us to snark on. Even if Josh is deposed, we will never see that deposition. Depositions are not necessarily public record. The court doesn't get a copy, at least in my state. The deposition would likely be kept confidential. 

I highly doubt Jill, Jessa or their parents would be deposed and any attorney worth their salt would fight those subpoenas. Realistically, the argument could be successfully made that their testimony is unnecessary and irrelevant. I cannot see any ethical judge saying he has no problem having them testify about child molestation in a case where he had consensual sex with an adult prostitute. Danica says that he was rough with her and that she felt dirty but she isn't saying that she was raped. Child molestation and what Danica is alleging are not the same thing. There is also no need for Jim Bob and Michelle to testify as to the child molestation. One does not have to do with the other as much as we may try to tie them together.You don't get complete free reign to ask or do anything you want just because there is a lawsuit. The court can limit testimony, depositions, written discovery, etc. if it feels that it is a fishing expedition not likely to lead to the discovery of admissible evidence. I despise Josh as much as the next person but I am not going to jump on the bandwagon of anyone just because they are going after him.

No always means no, no matter the relationship between the two, the past sexual history of either partner or their professions.

I think the doubt with her comes from the fact that she said she had sex with him a second time even after he was so rough that it was "torturous." Nowhere does she say she tried to end either encounter due to his behavior and she tip toes around calling it a rape.

But who willingly has sex a second time with someone who was so abusive that it felt like rape and was "torturous", especially if there was no personal relationship, even if he apologised?  

I believe she said to In Touch that she didn't know who he was until afterwards. He could've been a sadistic serial killer for all she knew. She should know as well as anyone that things can go wrong in a split second and she could've been even more seriously hurt than she's claiming or even killed.

We'll never know the truth. Josh is a pervert and her version seems questionable.

The women have little agency and do not have the luxury to pick and choose who their clients are and what clients they sees again. 

I'm not here for the victim blaming or sex work shaming.

I'm not a sex worker, so I don't know why she went back. But she did. That doesn't mean she wasn't scared. The fact that she went back after feeling scared is NOT what we should be snarking on. We should be snarking on the fact that her stories haven't matched up. We should be snarking on the fact that Josh is up shit creek without a paddle.

This. I'd like to add I was once at a job where I was sexually harassed - yeah I could have just quit, but it was the middle of the recession and my husband wasn't working. Sometimes you have to put up with horrible shit just to pay the bills. My situation isn't exactly the same but I can see why she may have needed to go back if she is the average bill paying American.

I fully believe if she had an alternative career choice she would not have gone back.  Chances are, she doesn't. So it's either no go back or not feed her family (IMO).

Wouldn't surprise me. I have a feeling that Jill and Jessa were told by JB and Michelle to go on TV and have the Megyn Kelly interview to "set the record straight" in the hopes of doing damage control for their brand.  Securing a money source is chosen over their kids, always. 

 

This. I'd like to add I was once at a job where I was sexually harassed - yeah I could have just quit, but it was the middle of the recession and my husband wasn't working. Sometimes you have to put up with horrible shit just to pay the bills. My situation isn't exactly the same but I can see why she may have needed to go back if she is the average bill paying American.

 

I've never been sexually harassed anywhere I've worked, but I have worked for an employer with a HORRIBLE safety record. I continued working there for 8 months after their most recent "mishap" that sent 3 of us to hospital because I had a mortgage and bills, jobs were scarce and I loved my coworkers. We never took any action against the company because they'd already gotten away with violating several OHS regulations many times before.
