Josh Duggar Part 9: Adult Film Star Lawsuits are so Godly

Previously in the Saga of Joshley Madison: Everyone's favorite Smuggar was outed as a child molester. When the furor over that had just about died down, it was revealed that he had not one, but two Ashley Madison accounts. He lost his job at the hate group, went home to Arkansas in disgrace, had a 2nd daughter, and went to "sex addiction rehab" at some religious labor camp.

Now! Porn star Danica Dillon is suing Josh for $500,000 for "physical and emotional injuries" incurred during their two paid consensual sexual encounters.

I propose the title of this thread to be changed to "Porn star lawsuits are not covered in the Wisdom Booklets," in honor of the awesome post in the previous thread by a poster whom I cannot remember. :)

While the rational part of myself, thinks this is nothing more, than a money-grab lawsuit, that should be dismissed.

The irrational part of myself, is totally overjoyed by this, and wants it to proceed, full steam ahead. I just have a glorious mental picture, of JB's reaction, to Josh being deposed.

will the case, if it actually does go to trial, be held in philadelphia, or where the other club is (about an hour away in a different county)? the first hotel room visit was in philadelphia, but i haven't heard where the second one took place. i would think *not in philly because of the distance from the creekside cabaret...

I am mystified as to how she can show Josh was the one who gave her the PTSD or whatever. If this is her job, who is not to say someone else also gave her problems. Not being a lawyer of course, what do I know? Nothing.

I'm not saying that she is insane but I did think of that quote as I was typing it. As the average person, I would not do it again if I were uncomfortable. No money would have been worth it for me. Then again, I don't work as a sex worker and they definitely do take more risks than the average person. She should not have been assaulted, that should never happen but it does to many. I just don't get the timing. Why wait?

Well, I am away from FJ for a few days and come back to yet another embarrassment in the Joshley's ever growing list of embarrassments.   I am not surprised that this has happened.  I am firmly of the opinion that not only is there probably more we don't know, but even with what we do know, Josh has opened a Pandora's box of even more damning allegations that will continue to do damage to him and the Duggar family brand.  Even if nothing really comes out of this lawsuit, one thing it does do is keep Josh's "sins" in the public mind.   This is going to be real interesting in light of his sisters' upcoming specials.   I bet Jessa is beyond pissed now.

JB must be going mad.  

In most states, there is a very, very easy way to protect assets in cases like this: Divorce.

But Anna might get away if she legally divorces Josh and is awarded the bulk of the assets.  

What's a con-man to do?!?

I would love to be a fly on the wall in the TTH right now.  JB and J'chelle must be totally freaking out while the J'slaves keep the younger kids upstairs and out of the blast zone.

I do feel for Anna, still.  She has gotten a totally shitty deal which keeps on getting worse.   I still don't think she will leave him but every time something else crops up with Joshley, I have hope that someday, something will tip her over the edge and she will say "enough".

Actually, she's suing for a number "in excess of $500,000".

Can't blame a girl for dreaming big.

I tried to answer a similar question in the earlier thread.  This is a general response to the question:  Why do people sometimes wait for a period of time before filing a personal injury lawsuit?  Danica did not file a criminal complaint against Josh.  Only a governmental agency could do that - the D.A.'s office in the country where a crime took place.  She's filing a civil lawsuit claiming that she suffered personal injuries (anxiety, stress) and that these injuries are affecting her ability to work and earn a living in the manner she was doing prior to her encounters with Josh.  In civil lawsuits, you have a time frame designated by law in which to file your lawsuit.  There is no need to rush on filing your suit.  It doesn't diminish your claim in any way.  That time frame is often used by attorneys to gather information and to attempt to resolve the case without the need for a lawsuit.  Maybe Danica wasn't sure whether she wanted to pursue a case against Josh; or maybe she started having panic attacks and they kept getting worse and she feels they are connected to her encounters with Josh.  I don't know the exact reason - only that it doesn't mean anything shady.  It only means that she didn't file her lawsuit until this moment in time, but well before the statute of limitations had run.

As to her asking for $500,000 or more in damages - that's also not uncommon in personal injury lawsuits.  It rarely has anything to do with the actual settlement amount.  I'd be surprised if this case ever reaches a jury.  Seems like the wisest course would be to enter into settlement talks.

Here's where being so sheltered did him a disservice. Most men with any kind of money know better than to put themselves into such a vulnerable position. I say "most" because let's face it, men can be dumb when it comes to their penises. But yeah, a more worldly man would have been more savvy in finding ways to get some strange way more on the down-low. From the Ashley Madison accounts and the soliciting sex in strip clubs, it all screams dorky amateur.

I am pretty sure that JB has made sure that Anna has no assets- she probably has never even had a cell phone in her own name let alone possessed the title to a car or been on a lease.  I really wouldn't be surprised if JB & M somehow conned J&A into signing over some sort of guardianship for the kids under the guise of temporarily making sure the children are protected from CPS, etc. .  I have known of fundie families doing this before when the father has strayed, gone to jail, rehab, etc.  All the easier to keep your daughter or daughter-in-law towing the family line....

I don't think, prior to all of the scandals, anyone would have believed her. She is filing now, because the specials are getting ready to air, which if there is any merit to her suit, the Duggars would probably be more likely to go the settlement route, instead of the trial route. That's my theory anyways.

On one hand, my mind goes straight to "cash grab".
On the other, I can see why someone would wait to sue. If you don't think you'll be believed you may not do anything unless something like this comes up, or other people come forward.
And I can see how a sex trade worker would return a second time. It is a job that carries with it a high degree of risk. Every day you would be at risk of exposure to STDs, violence and all other kinds of awfulness. I can see many of them being fully aware of the risk but taking the chance because every day you are already playing high stakes.

Prior to the scandals no one would have believed it but post Ashley Madison when it was all fresh might have been the time to do it in my opinion. When it was fresh in the people's mind that this guy was sleazy, he had molested his sisters, he had cheated, why wouldn't he? I think that Josh is still a sleazy character, there is no doubt about that but I think with his disappearance, most of the general public has forgotten about him.

If there's dirt on any of the other Duggars, I want it to come out. I hope to God it wouldn't involve any other victims, or that if it did, their identities would be protected, but yeah. Right now they can try and claim that Josh is just a bad apple. "Well, all families have their problems. Look, we've got 19 kids and only one of them went astray! That's pretty good, isn't it?" Before the molestation scandal broke I really thought that the Duggars were a ticking time bomb, that they were about to be brought down by something, but I was convinced it was going to be something financial. I still think that about JB. Like another recently said, I don't think he's an 'evil overlord', but he is greedy, manipulative, and not nearly as smart as he thinks he is. He's trying to set up his own little kingdom where the law is the Law of Jim Bob. I think the real law is going to catch up with him and bite him in the ass.

Yes, exactly! Intellectually this lawsuit sounds bogus and in the grand scheme of thing I think it should fail. But it's the Duggars, I'm thrilled and hope they go down in flames.

The more these "embarassments" occur, the more likely any other stuff will come out.  It keeps the negative attention on them and the more negative attention increases the likelihood of other shenangians, either personal or financial, coming out.  Either someone will make it their business to find out (which I believe was the case in the molestations) or things like lawsuits, where other information is inadvertently found.

And I agree that JB is not an evil overlord, just a legend in his own mind.  He believes he knows it all, doesn't think he has to listen to anybody, and will rationalize his greed   His decisions, particularly with regard to his children, are already biting him in the butt.

Rape/sexual assault/ sex related civil claims are often very difficult to pursue, especially for women who have reputations for being "immoral." As a sex worker, I think Danica needs all the help she can get regarding timing and public perception to get a fair hearing. I can see how she would want to proceed very carefully, especially in terms of making sure she had a case before going public.
