A Texas drama teacher accused of having sex with one of his students has seen all charges against him dropped after he married the teen police had said was his victim.

Ilich Guardiola, 41, was initially questioned by police in April when he was stopped for a traffic violation while riding with the 16-year-old girl in his car. The teen eventually told authorities she was in love with Guardiola and they were in a relationship, according to KHOU.

Before authorities busted him in May for the improper relationship, Guardiola had flown to Las Vegas with the girl and married her with the teen's mother as the witness, according to KPRC.

Authorities said they found text messages between Guardiola and the girl, who was one of his students at the Houston Family Arts Center.

One of the texts allegedly sent by the girl to Guardiola said "I love having sex with you."

Now, KHOU reports, that the sexual assault of a child charge against Guardiola has been dropped and his lawyer told the station it was because of the marriage.

The Houston Family Arts Center cancelled its contract with Guardiola after the accusations arose.

not sure but may be a real pain to try him now. I know it is illegal to have a wife testify against a husband. but he is sure not husband material.

You are probably right that it's too much trouble to try him because the mother blessed the marriage. He lost his job, hopefully there will be enough notoriety that he will never be hired in any sort of job that puts him in contact with teens.

I'm sure whoever was going to prosecute this has to pick their battles and this probably didn't seem winnable due to the marriage but ugh.. .still... he broke the law. Maybe justice will come after the inevitable divorce.

this is quite oversimplified. it is not illegal for a wife to testify against a husband if she wants to. and there are provisions that have to be met as to what can be claimed for the marriage confidentiality privilege.

This is disgusting! Same type of thing occurred at my high school in Texas- the FCA President was the daughter of a fundie-lite pastor. They were caught up at the school together by her parents and after she admitted to kissing him they got married. Of course, he had to step down as a teacher and coach and she finished out her senior year with home school.

I heard they are still married today (18 years later) and have a whole brood of kids. They moved out of state and he is teaching and coaching their now. The creepy factor is just outrageous.

In my country, the age of consent is the same as the age at which you can get married (with parental consent).

(... although it's complicated in the case of a teacher - random unconnected person can have sex with a 16yo but their teacher can't.)

Your guess is incorrect. As I said, there was a slideshow and most of the stories depicted in that slideshow were from CA.

The stories happen all over the US. The first and most famous, Mary Kay Letourneau, was from CA.

It is just your perception that "most" come from TX and FL. My guess about you is you just hate the Bush family that much.

To this I would just say that he probably enjoys it very much. The big draw for May-December relationships generally has more to do with the older person preferring the company of someone they can manipulate, control... not looking for an equal partner. Partners your own age come with baggage - kids, exes, etc.

I'm kind of a nerd and I pay attention to the credits whenever I watch Anime, and I thought his name sounded familiar. Illich Guardiola is a fairly well-known voice actor who has done work in many Anime series. I knew the name sounded familiar and double-checked it.

I think you hear about this a lot from TX, FL and CA because the three states that have HUGE populations. I don't think it is specific to any one area of the USA, but happens everywhere.

Texas alone have 25 million+ residents.
