I have a question. Is Switched on Schoolroom better then ATI wisdom books? I would imagine that they are but I have never been exposed to either program.

The event was held on private property so, there may be some legal standing.

I don't see how it could be enforced. First, they have no record of when the sign was erected and according to FMJ the sign was not up when she went inside the gate. Second no one was asked to sign anything which would be proof of agreement.

My guess is that the sign is a symbolic gesture in an attempt to control average citizens who don't want to worry about legalities. I liken it to the gravel trucks in my area who put signs on the back of their open trucks claiming no responsibility for flying gravel-- just because they make that statement it does not mean it would hold up in court but the average citizen would take it as a legal maneuver and not press the case.

And I really have to question the idea of holding a public sale on your property, advertising to all and sundry, and then getting upset when the public shows up, takes pictures, and asks questions. It is such a ludicrous notion that you can control everyone whom you and your family can come into contact with, especially when you court fame. I, personally, see nothing wrong with asking questions of minor children when invited onto their property, although I do think the spy pen was too much. If the Duggars were so all-fired nervous about minors being questioned, then they should have either chaperoned the kids or else had them play inside. I'm pretty sure that they were not asked to stay inside because once again Papa Pimp wanted to make money off their appearance.

Imagine if Pitt and Jolie had a yard sale at their house for charity and allowed their children to interact with strangers. Do you not think that they would be inundated with journalists asking questions and taking photographs?

I'm not a lawyer, but would think that the sign has no legal standing for a public event. They likely can impose picture/video restrictions to a closed event. I doubt that they could limit discussion of any event, even on social media, unless one signed a confidentiality agreement. I could be wrong.

In other Duggar news, the Bontragers have posted pics from their Labor Day event featuring the Duggars: bontragersingers.blogspot.com/ -- only a few pics are of the Duggars. Looks like TLC certainly wasn't filming.

Some states require both parties to consent to being recorded. If that is the case where FMJ secretly recorded the Duggars, she may have violated the law. Having said that, the prohibitions outlined on Smuggar's sign wouldhave no effect at a public venue/event, other than maybe to show that the Duggars did not agree to being recorded.

It was posted by the user "lyingisasin."

IIRC "lyingisasin" also posted on Anna or Josh's instagram about the Proverbs Family controversy.

In other Duggar news, the Bontragers have posted pics from their Labor Day event featuring the Duggars: bontragersingers.blogspot.com/ -- only a few pics are of the Duggars. Looks like TLC certainly wasn't filming.

I just looked at their pics-wow 1500 people were there! What an undertaking! Saw a couple of pics with JB and Michelle and a couple of the family playing their instruments. I think it was Jill who was wearing cowboy boots (cuter than the usual flippy flops) and it may have been Jana in a stylish black/white print skirt.

The poster on IG just said they saw a young women being taken away by the police. No mention of being cuffed.

I agree whoever it was that said the smart money was on TLC calling the cops. Given how much the Duggars like to overexpose themselves (at least the parents), and especially the fact that the parents agreed to be photographed with the creepy guy who showed up at the event to try and meet Jedediah, I'm not sure they would really care too much about a woman who showed up with a baby and a friend, even if she did discuss it beforehand here.

ETA: And when I think about it further, they probably would have simply taken it as an opportunity to minister to FMJ, had she been allowed to remain.

My husband is licensed in Arkansas. PM me if you want info. We know a large portion of the attorneys in NWA. IIRC, Arkansas is a one-party consent state, which means as long as one person consents to being recorded (in this case, you), you can recorded whomever you want. They can't enforce a social media blackout at a public event. Hello, freedom of speech!

That I would have to ask dh about. I was not aware that any kind of hidden camera was illegal in this state, but it doesn't mean it's not. All I know for certain (because I just checked) is audio. I am pretty sure that if it's a public area, you can record whatever video you want, so a public event on private property may be sticky. I tend to agree with whoever it was that said that with other cameras going and with an invitation to the public, the Duggars should not have an expectation of privacy to violate. That doesn't mean it's not illegal, just that I am skeptical. When dh gets out of court, I'll ask him.

ETA: I found the code. I think I know what they are saying FMJ violated, but I won't post it here because it would be really dumb to hand the infraction along with a defense you could use to a public forum where the opposition could read it!

This one is about the buddy system. I thought that Jana, Jill Jessa and Jinger were the primary parents to the younger kids. J'Chelle and Boob obviously gave up years ago. I wonder if Anna also has the buddy system in place with Mack and Mike. I hope not. It's not Mack's job to raise her brothers. It's Smugger and Anna's. If they're going to become like J'Chelle and Boob, they should stop at three kids.

I wonder if part of the concern is that photos of non-Duggars might be posted?

I know at work functions we always had to get consent forms signed if we wanted to use any photos for p.r. , which can be a real hassle to track down if you have a crowd.

I have no idea as to whether a hidden camera is illegal or not - but it's wrong. If FMJ had a video camera in plain sight it gives the Duggars (or anyone else who was there)the right to either consent or decline being filmed. With the camera hidden, she was taking that right away from them. This entire scenario is slightly bizarre, folks. It could lead some to wonder just who the (weird, strange, eccentric, odd)ones really are. No offense intended, sometimes the lines can get a little blurry and it's easy to step over them - most all of us have been at some point in our lives.

I didn't think that TLC would film - the Bontrager event is for true believers and would be way more overtly fundie than most TLC viewers would be comfortable with.

Part 6 was locked (by me) as a temporary measure until the legal minds of FJ gave their opinion on how things should proceed. They ruled that there was no need to archive the thread.

If FMJ chooses to post here about the incident and others choose to speculate about said incident and the legalities involved, they do so at their own risk and with the knowledge that this is a public forum that any prosecutors in any subsequent legal case will be able to access.
