Attorney says 11 year old lured boys to gang rape her

I feel sick reading this. The girl in question is a CHILD.

Taylor questioned why the underage girl had not been charged with anything for choosing to violate that rule, indicating that she was "the reason" that the encounters happened.

"Like the spider and the fly. Wasn't she saying, 'Come into my parlor, said the spider to the fly?' " Taylor asked.

"I wouldn't call her a spider," Langdon replied. "I'd say she was just an 11-year-old girl."

"I hope nothing like this ever happens to your two teenage sons," Taylor snapped back.

The incident raised racial tensions in the 8,000-strong community of Celveland, Texas, as the suspects are all black and the girl is of Mexican descent.

Latino community leaders defended the young girl, saying people who have questioned her parental supervision and dress are re-victimizing her.

The comments were in response to black activist Quanell X who earlier this month said he was concerned that only young black men had been arrested.

He went on to question why the girl didn’t report the attack herself. Some who attended a meeting where Quanell spoke, blamed the girl for the way she dressed and claimed she lied about her age.

Cruse already is serving an eight-year sentence on convictions for aggravated robbery and aggravated assault with a deadly weapon.

Taylor told jurors in his closing remarks, "She told you she was a willing participant. But they'll tell you the law doesn't care ... off with their heads!"

But he questioned whether the law can be that absolute.

"People don't come with signs telling their age," Taylor said. "How does a young man know? You can't cut off their legs and count the rings like a tree."

Prosecutors countered that the law provides no excuse for sex with children. Otherwise, they argued, adults can take advantage of a child's naïveté and innocence.

Because the sexual assault was videotaped by the participants, the only defense Cruse can raise is say to say it's her fault, prosecutor Joe Warren said.

"Look at how proud he is on that video as his buddies say 'beat that ho,'" Warren said.

That Attorney is horrible!

What the fuck is wrong with people?

Not going to defend this attorney, but he has to say this nasty-ass shit, otherwise he may be sued for not properly representing his client. The PROSECUTION and the JUDGE were remiss here in not shutting down the line of questioning. That would have covered the defense attorney's ass. The girl is only 13-14 now, and STILL under the age of consent. (And, you'll notice, she was testifying anonymously because of her age.)

The judge's instructions had better include something about "you will find the defendant guilty if you determine he did in fact have intercourse with the victim. You will also note the victim is not old enough to consent to sexual intercourse no matter what she says." Or some such.

This whole thing was nasty, nasty, nasty, awful from the start. Apparently there were something like 20 young men/boys having sex with this 11 year old girl. $%^&*()!@#$!!!

Okay, perhaps I'm just naive... but what 11 year old looks like a 17 year old? I mean, even if she was wearing "revealing" clothing and such.. she's 11. At most she's just STARTING puberty... and at 17, chances are you aren't just starting that... so that excuse is stupid. Seriously. I could understand if she was 16, claiming to be 17, them not knowing.. but 11? C'mon....

I am at a loss of words for the way the defense handled this. I know they have to defend their client, but this is just sickening.

I hope the girl gets counselling and help after all this. She not only had to endure what happened to her, but she also has to endure the media scrutiny and the fact that, to her face, a lawyer told her she wanted it and she was at fault. I really hope she is able to get help and go on to live as normal a life as she can.

I went through puberty at 9. By 11, I looked 14 or so, but definitely NOT 17

My sons' school used to have weekly open assemblies so that parents could sit behind the kids and watch certificates being given out. Every year for several years running there was at least one girl in Year 6 (the year of their 11th birthday) who, had I heard her in the park saying "I'm 16" I would have believed without a second thought. Even if she didn't have makeup on. This was quite a scary realisation...

I may have squinted a tiny bit at the thought of her being 18 (I'm not sure what the relevant age is in this case) but not much. Even some of the flatter-chested girls in Year 6 can be taller than their mothers (historically poor area round here).

It's not that improbable, especially not today when children are maturing sooner. I largely had my adult figure by twelve, and I knew one girl, much later, who at eleven suddenly had a massive growth and developmental spurt and within the year did look seventeen or so.

However, I don't know many eleven year olds who both look AND act much older than they are. Once you talk to them, you can tell they aren't as old as they look. And I highly doubt any of them would consent (even disregarding the fact that they really can't at that age) to filmed sex with multiple partners.

I am shocked by all this! Most of the 11 year olds I know, while they may have started puberty and started to look more womanly... they are no where near the 18 and 17 year olds I know when it comes to looks.

I will never understand this argument. It's the same one used in the courts for prosecuting underage prostitutes. Whatever kind of horror show justice system believes that a TWELVE year old can consent to prostitution is fucking beyond me. This is disgusting, and I can't even imagine what kind of person would be able to sleep at night after making this kind of argument. Don't care if it's his job, don't care.

Just now on my facebook someone posted that her 16yo daughter had gotten 10 calls threatening to "rape" and "kill" her. They went to the cops, who were going to open an investigation, so then a "friend" of hers confessed. They decided not to press charges. And then she finds out his parents are excusing behavior saying she had "said suggestive stuff" to him before. And that she had blown it all out of proportion, especially by going to the cops. WHAT could she have said that was suggestive that would have justified her being threatened with rape and murder??? Its not ok to excuse your kids rotten behavior, people.

Taylor asked Jared McPherson, who is serving a 15-year sentence for assaulting the same girl, if she had lied about her age to him, but prosecutors objected and he was barred from answering.

To the other person in regard to defending his client. There is always a choice. Maybe he was the third or fourth. Maybe he was free. Maybe he was APPOINTED I have no idea. Whatever the circumstances he chose to make some bad decisions Mr Taylor. Big bad ones. He chose to do that as an educated adult. School. College. Law School.

Some ..is it 20 odd guys? Chose to forget that children don't know always know what they are doing (I base this on their prosecution, not at all on fact. )They took advantage of that, then blame the child. SO not one knew? Give me a fucking break. Did they all land from totally different demographics? Like MILES apart..not know each other? Yeah. But those defending them?

Why did she say yes when they asked her if she was a willing participant? I thought she wasn't. Not that it matters anyway because she was underage. Their questioning seems weird.

I remember hearing about this when it happened and it made me feel so sick.

I think 12-13 year olds and older can look pretty grown-up but an 11 year old? That's a huge stretch, even if they are an early developer. They have a young face and they will obviously not be at all mature in how they speak and act. I don't understand. Why would SO MANY older men be interested in that rather than just one or two freaks. :-(

We have some early developers in my daughter's middle school (5th and 6th grade only). Some of them dress a little provocatively, I imagine mainly because those are the clothes out in the malls for a size 5 teen female. I think it is poor decision-making on the part of the parents, but the child has nothing to do with it and certainly should not be raped as a result.

And when you talk to them, they are clearly 11. The oldest I would place one is 14 or 15. When you look beyond the boobs at their faces, they are obviously not adults.

There is a lot of racial tensions in this case. Very small town, lots of

hatred towards Latinos. I'm not excusing it, that's the situation.

From my

perspective, it's more of a male/female issue.

I'd like to see celebrity African-American women speak out on that child's behalf. The rape apology and victim blaming by the activists is shameful.

I'd like to see the defendants charged in federal court with child pornography.

That kind of crap is NOT tolerated in federal court, at least not where I practice.

Even if the girl says she was a willing participant, there is no way she can consent. Whether she was "willing" or not shouldn't even be a factor. I can't believe that anyone would try to argue that how she was dressed even matters. She's 11, ffs. She's still a baby.

I have seen shows in which men were prosecuted for having sex with underage girls who claimed to be older and there was not even a huge age difference. Adults are responsible for knowing the ages of their sexual partners and establishing that they are not about to rape a minor. Maybe laws are different in Texas, but how is this an effective defense?
