Trump Admin Will Protect Health Workers Who Refuse Services On Religious Grounds

Health care workers who want to refuse to treat patients because of religious or moral beliefs will have a new defender in the Trump administration.

The top civil rights official at the Department of Health and Human Services is creating the Division of Conscience and Religious Freedom to protect doctors, nurses and other health care workers who refuse to take part in procedures like abortion or treat certain people because of moral or religious objections.

"Never forget that religious freedom is a primary freedom, that it is a civil right that deserves enforcement and respect," said Roger Severino, the director of HHS's Office for Civil Rights, at a ceremony to announce the new division.

The establishment of the division reverses an Obama-era policy that barred health care workers from refusing to treat transgender individuals or people who have had or are seeking abortions.

That Obama rule was challenged in court by the Franciscan Alliance, a Christian health care organization in Texas, and a judge in 2016 blocked enforcement as the case played out in court.

The new division appears to be primarily aimed at preventing health care workers from participating in abortion services that go against their religious beliefs. The division cites a 2011 federal regulation guiding the enforcement of conscience protections that mentions abortion more than 30 times.

Louise Melling, deputy legal director at the American Civil Liberties Union, said those conscience objections could expand to allow health workers to refuse some services to gay, lesbian and transgender people.

"This administration has taken a very expansive view of religious liberty," she said in an interview. "It understands religious liberty to override antidiscrimination principles."

HHS makes clear that it won't allow gender discrimination that is banned by federal law. The question, according to Melling, is whether the administration includes gender identity and sexual orientation in the definition of gender.

She says there are many examples of health workers refusing care on religious grounds, including a nurse who didn't want to provide post-operative care to a woman who had an abortion, a pediatrician who declined to see a child because his parents were lesbians and a fertility doctor who didn't want to provide services to a lesbian couple.

Acting HHS Secretary Eric Hargan said Thursday that is the point.

"For too long too many of these health care practitioners have been bullied and discriminated against because of their religious beliefs and moral conviction," he said.

The government, he said, has "hounded religious hospitals and the men and women who staff them, forcing them to provide and refer for services that violate their consciences."

The new division won't have to wait to get to work. A pediatric nurse at the Winnebago County Health Department in Illinois filed a complaint with HHS on Tuesday because she objects to her employer requiring that she be trained to make referrals to providers of abortion services or to help woman get abortion drugs, according to the Rockford Register Star.

This isn't the first time in the Trump administration that HHS's Office of Civil Rights has moved to protect people with moral or religious objections to some kinds of health care. In October, the agency allowed employers to refuse to pay for birth control coverage.

"Health providers should have the ability to live their religious beliefs without fear of workplace discrimination," said Sen. James Lankford, R-Okla., in a statement.

Lankford has long advocated for such protections and has sponsored a bill called the Conscience Protection Act to codify the rules.

Do if a woman comes in with an ectopic pregnancy can a doctor just refuse to abort leaving the woman to die? And we all know it won't just stop at abortions. Soon doctors will start to refuse to treat a person of color or a non-christian.

As for this BS with HHS they should be very careful. They're too stupid to understand that it works both ways. This certainly allows me to refuse to have someone I consider to be a Devil-worshipper touch me in a medical setting. My religion tells me that might put my eternal life in danger. And I feel like those fake Christians are Devil-worshippers so... When these hospitals become places where people are allowed to die, they will go under. When your employees start refusing to help certain people that shit can spread among the ignorant like the flu. Then what do you do? Eventually you become the hospital known as the one who judges everyone who comes in the door.  Better be careful, Nurse Jackie may know about your cocaine habit, your affair with her sister's husband and that you worked as a stripper to get through college. No service for you because Jackie and her Christian bitches are running the ED!

@GrumpyGran, @onekidanddone and @candygirl200413, so if I were a nurse that thought Fundies were utterly obnoxious, could I tell them they haven't been praying hard enough, since they have health problems, and I can't treat anyone of such weak faith? (Normal mainstream Christians, people of other faiths, and atheists are totally okay, just not fundies and evangelicals)

Jehovah's Witnesses are against blood transfusions.  I worked with a JW nurse who had no problem giving blood transfusions to patients, even though it was something she'd refuse for herself.  How long until a nurse refuses to administer a vaccination or psychiatric medication because his or her pastor said such medicines are evil?

Yeah, this is what it's all about. These short-sighted hypocrites want to shove their ignorant beliefs down everybody else's throat but don't realize that this will open up a huge can of worms. They think this will stop with refusing to assist with abortion but some will take it too far and the lawsuits will drive hospitals into bankruptcy. You cannot put decisions about dispensing health care into the hands of individuals.

If it were up to me they would be. However, contrary to popular belief, doctors do not swear the Hippocratic Oath anymore.

The American Medical Association does have these Principles of Medical Ethics:

I. A physician shall be dedicated to providing competent medical care, with compassion and respect for human dignity and rights.

This principle could be used as an argument to sue for negligent homicide, as refusal to treat could be seen as not being dedicated to providing competent medical care.

II. A physician shall uphold the standards of professionalism, be honest in all professional interactions, and strive to report physicians deficient in character or competence, or engaging in fraud or deception, to appropriate entities.

This principle could be the one by which another doctor reports the shit hole doctor.

This principle is a doozy in contrariness. First respect the law (so you don't have to treat a non-christian) but if it's contrary to the best interests of the patient (which non-treatment is) then this principle should be used to seek changes in the law.

As the above principle, also contradictory, and in my view almost the same as principle III.

So, in order to answer your question @onekidanddone: Shit hole doctors can refuse to treat a non-emergency patient, but they have to make sure said patient gets medical care. This means that if they don't, and the patient dies because of it, they can indeed be sued.

Sorry I just read this again and I got so fucking pissed again. It kind of reminded me of that famous picture of the guy in the klan hood who was getting help int he ER by black nurses/doctors. Like assisting someone who HATES them by their skin color and yet they still did their damn job.

Like obviously everything he's ever done has pissed me off but then still got me enraged, like how I felt with his comments on Mexicans and that disabled reporter. Fuck this man and you're right @onekidanddone he is a shit fuck!

WSJ is reporting on Porngate (Stormgate?) and the $130,000 payoff to Stormy Daniels.  One reason I'm glad to see this is that many staunch conservatives are getting an earful direct from their favorite conservative publication, which, in general, makes it harder to defend Trump around the water cooler or at the extended family get together, or to anybody else in any other circumstance.  And now that WSJ has begun reporting this stuff, they aren't going to stop.  It's much, much harder to use the fake news narrative against the WSJ and have it stick. 

Anyway, this is just the tip of the Porngate iceberg, and in keeping with this metaphor, the White House is the Titanic.  

And here's another thing.  Trump & Family are crooks with a crook's mindset and as Trump's own son noted, the only color Trump sees is green.  They won't deal with money honestly.  They can't.  It isn't in their DNA.  They will skate along the legal/illegal border and cross into illegality if they feel safe doing so, because laws are for chumps.  If you get caught, deny deny deny, declare bankruptcy, sell your soul to the Russians for bail out, pay somebody off, let a chump take the fall, sue somebody, use the condos to launder money.  With Mueller on the trail investigating finances, $$$$$$ will be the Trumps' downfall.
